Welcome to the Gacha Online Custom Content Uploader (the "Service"), operated by Team Snowdust ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Service. Please read these Terms carefully before using the Service.

By accessing or using the Service, including checking the acceptance box during upload, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Definitions

  • "Service" refers to the Gacha Online Custom Content Uploader website and its related functionalities.
  • "User," "You," "Your" refers to the individual accessing or using the Service.
  • "Content" refers to the .psd files, images, data, Artist Name, and any other materials uploaded or submitted by you to the Service.
  • "Gacha Online" refers to the Gacha Online game and related platforms.
  • "Team Snowdust" refers to the entity operating the Service and Gacha Online.

2. User Accounts

To use the upload features of the Service, you must register and log in using a Google Account. You are responsible for safeguarding your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. User Conduct

You agree not to use the Service to:

  • Upload, post, or transmit any Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Upload, post, or transmit any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Upload Content containing viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer or the Service.
  • Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service.
  • Violate any applicable local, state, national, or international law.
  • Upload Content that violates Roblox's Community Standards.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.

4. Content Uploads

  • Representations and Warranties: By uploading Content, you represent and warrant that:
    • You are the rightful Copyright owner for all images and files uploaded.
    • You have the necessary rights, licenses, consents, and permissions to grant the license set forth in these Terms.
    • The Content does not violate the User Conduct rules outlined above or infringe on any third-party rights.
  • License Grant: By checking the acceptance box and uploading your Content, you grant us (Gacha Online and Team Snowdust) a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, modify, adapt, publish, and otherwise use the Content in any capacity and in any media formats and through any media channels now known or hereafter developed in connection with the Service, Gacha Online, and Team Snowdust's business, including for promoting and redistributing part or all of the Service or Gacha Online (and derivative works thereof). You understand that you will still retain ownership rights of your uploaded Content, subject to the license granted herein.
  • Content Moderation: You acknowledge that all uploaded Content may be subject to review and moderation, including automated checks and manual vetting. We reserve the right, but not the obligation, to reject, remove, or modify Content that we determine, in our sole discretion, violates these Terms or is otherwise inappropriate.
  • Deletion Requests: You acknowledge that while we will try to accommodate requests for the deletion of your uploaded Content, we may not be able to due to technical limitations, the perpetual nature of the license granted, or the integration of the Content into Gacha Online or other systems. Please only upload Content if you are comfortable with this possibility and the provided terms.

5. Intellectual Property

Excluding your Content (for which you grant us a license as described above), the Service and its original content, features, and functionality are and will remain the exclusive property of Team Snowdust and its licensors. The Service is protected by copyright, trademark, and other laws of Wyoming, United States and foreign countries.

6. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS; THAT THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED OR SECURE; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TEAM SNOWDUST, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE. UNDER NO CIRCUMSTANCES WILL WE BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

8. Indemnification

You agree to defend, indemnify, and hold harmless Team Snowdust and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account; b) a breach of these Terms, or c) Content posted on the Service, especially any claim that your Content infringes the copyright or intellectual property rights of a third party.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Wyoming, United States, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
